Rent Smart Wales Registration and Licensing

First and foremost, if you own a rental property in Wales, you must comply with Rent Smart Wales. This isn't just a recommendation; it's a legal obligation. As a landlord, you need to register yourself and your properties. If you manage the property yourself, you'll also need to obtain a landlord licence, which involves completing approved training. Gas Safety Certificate

For any property with a gas supply, a valid Gas Safety Certificate (CP12) is mandatory. This must be carried out annually by a Gas Safe registered engineer. It ensures all gas appliances, flues, and pipework are safe to use. Always keep a copy for your records and provide one to your occupant.

Electrical Installation Condition Report (EICR)

Electrical safety is paramount. You must have an Electrical Installation Condition Report (EICR) carried out by a qualified electrician every five years, or sooner if recommended. This report checks the safety of the electrical installations in your property, identifying any potential hazards. Again, a copy must be provided to your occupant.

Energy Performance Certificate (EPC)

An Energy Performance Certificate (EPC) is required for all rental properties. This certificate gives your property an energy efficiency rating from A (most efficient) to G (least efficient). Currently, your property must achieve a minimum rating of 'E' before it can be let. An EPC is valid for 10 years.

Smoke and Carbon Monoxide Alarms

Ensuring your property has working smoke alarms on each storey and a carbon monoxide alarm in any room with a solid fuel burning appliance (like a log burner) is a legal requirement. These should be tested at the start of each new occupation contract to ensure they are in good working order.

Deposit Protection Scheme

If you take a security deposit from your occupant, it must be protected in one of the government-approved tenancy deposit schemes within 30 days of receipt. This protects both you and your occupant, ensuring fair handling of the deposit. You must also provide your occupant with prescribed information about the scheme used.

Occupation Contracts (Not Tenancy Agreements)

Since December 2022, the way homes are rented in Wales changed with the introduction of the Renting Homes (Wales) Act. What were once 'tenancy agreements' are now 'occupation contracts'. These contracts set out the rights and responsibilities of both the landlord and the 'contract-holder' (occupant). It's crucial to have a legally compliant occupation contract in place before your occupant moves in.
